Hubble Contacts to pay $3.5 million to settle with FTC

Vision Path Inc., which does business as Hubble Contacts, has been ordered to pay a $1.5 million civil penalty and $2 million in consumer damages as part of a federal settlement.
The settlement will resolve allegations that the online contact lens company violated the Contact Lens Consumer Fairness Act and FTC contact lens rules.
“The Department of Justice will not tolerate violations of laws designed to ensure consumers receive the products prescribed for them,” said Brian M. In a lawsuit filed in U.S. District Court for the District of Columbia, the government alleges Hubble violated the federal Contact Lens Consumer Fairness Act and the FTC’s Contact Lenses by selling contact lenses online without taking the necessary steps to verify subscribers’ contact information rule.Lens prescriptions, improperly replacing contact lenses originally prescribed by consumer eye care practitioners with Hubble’s own brand of contact lenses, and obtaining what it falsely describes as independent consumer reviews of its products and services.In addition to requiring Hubble to pay civil penalties and consumer damages, the court’s prescribed order today requires Hubble not to change prescriptions to change prescription brands, verify prescriptions for contact lens orders that do not submit written prescriptions, cease other deceptive practices, and satisfy Ongoing record keeping, certification and compliance obligations.
“Hubble’s business model increases profits but creates unnecessary risks to customers’ eye health,” said Samuel Levine, director of the FTC’s Bureau of Consumer Protection. “Today’s action clearly demonstrates that, Companies will pay for deceiving customers, ignoring contact lens rules and using misleading reviews.”
