Costco lawsuit claims woman contracted contact lens infection

According to a recent Costco lawsuit, a lawsuit has been filed against Costco alleging that it sold defective contact lenses that gave a patient an eye infection and forced her to return the allegedly defective contact lenses so she could not retain them as evidence.
Plaintiffs Sarah Alexander and her husband Robert Roy Alexander filed the Costco lawsuit July 19 in federal court in Nevada.
Sarah Alexander reportedly has to wear special rigid gas permeable (RGP) contact lenses due to her keratoconus. Robert Alexander worked at Costco and had health insurance that allowed them to fill prescriptions through Costco’s eye department.
Sarah Alexander said she had the left RGP lens custom-made by her optometrist and sent the prescription to Costco. Costco sent the prescriptions to defendant Valley Contax Inc. so that the lenses could be manufactured according to standard procedures.
About a week after wearing Costco contact lenses, Sarah Alexander began experiencing discomfort in her left eye. The symptoms did not disappear, and she went to the ophthalmologist for an examination, where she was diagnosed with toxic-allergic conjunctivitis.
The optometrist reportedly found that the left lens did not fit properly and was covered in toxic “soap residue.” Costco’s lawsuit alleges that Sarah Alexander immediately reported the results to Costco’s optical department.

The Costco contact lens lawsuit states, “After discovering a problem with the contact lenses, defendant Costco began attempting to force plaintiff to return the contact lenses.”
Sarah Alexander says a Costco optical department employee told her she was delaying the FDA investigation because she kept allegedly defective contact lenses and told her her health insurance benefits could be suspended.
The Costco employee also allegedly discussed returning Costco contact lenses with Robert Alexander at work.
The Alexanders said they were “concerned” about returning the Costco contact lenses because they were the only evidence of the alleged defect, but they wanted to comply with the FDA’s investigation and not lose their health insurance benefits.
They also said Costco assured them the lenses would be marked as evidence and mailed to Valley Contax. However, according to Costco’s lawsuit, Costco permanently destroyed the allegedly defective contact lenses.
Alexander filed a lawsuit against Costco, alleging that the company violated its obligations to preserve evidence that could be used in future lawsuits.
A Costco class action lawsuit filed last year accuses the company of falsely advertising its tuna products as “dolphin safe.”
