Disposable contact lens antitrust $75 million class action settlement

Consumers may benefit from a $75 million joint settlement with the maker of disposable contact lenses to settle claims for violations of antitrust laws.
The settlement benefits consumers who purchased certain disposable contact lenses between June 1, 2013 and December 4, 2018.The contact lenses in the settlement are sold by Johnson & Johnson Vision Care, Alcon Vision, CooperVision, ABB Concise Optical Group and Bausch & Lomb. Alcon and Johnson & Johnson Vision Care are two vision companies that manufacture contact lenses.Consumers who use disposable contact lenses may have purchased products from these companies through their eye doctor’s office or pharmacy.

Alcon and Johnson & Johnson violated federal law by conspiring with CooperVision, ABB and Bausch & Lomb to artificially inflate the price of disposable contact lenses, according to an antitrust class action lawsuit.It is said that starting in June 2013, the companies agreed to implement a unilateral pricing policy, setting a minimum retail price for disposable contact lenses.
Because of the program, consumers are said to be paying more for contact lenses than they would in the health market.Without the supposedly anti-competitive agreement, the defendants would allegedly lower the prices of their products in order to remain competitive and attract customers.
Alcon and Johnson & Johnson Vision Care have agreed to settle their claims in a $75 million class action settlement.
Alcon will contribute $20 million, while Johnson & Johnson will contribute $55 million.The funds join previous settlements with CooperVision and ABB Optical Group.
Under the terms of the contact lens settlement, class members can recover cash payments for single-use contact lenses.
Each consumer will be eligible to receive a proportional share of all five settlement funds based on the number of eligible lenses each consumer purchased during the class action.There are currently no payment estimates available.
Class members must submit proof of purchase for the disposable contact lenses they purchased.This includes receipts or other documents.
To benefit from the contact lens settlement, class members must submit a valid claim form by August 22, 2022.
Consumers submitting claims for previous ABB, Bausch & Lomb and/or CooperVision settlements are not required to submit another claim form as the information they previously submitted will be used for payment.
